According to the "Speech and Debate Clause", Congressmen CAN be sued, for libel, etc. when they make statements during radio or television interviews.

They are CLEARLY not IN session, nor are they "on their way" to or from session. In addition, they are NOT making political speeches or trying to garner votes. Hence, the "Speech and Debate" clause DOES NOT APPLY.
